第一章 总 则
第一条 为了保证《中华人民共和国城市规划法》(以下简称《城市规划法》)的实施,结合自治区实际,制定本办法。
第二条 凡在本自治区行政区域内制定和实施城市规划,以及在城市规划区内进行建设,必须遵守《城市规划法》和本办法。
第三条 本办法所指城市规划区,包括城市市区、近郊区和规划控制区。
(一)市区是指城市建成区以及城市基础设施和公用设施基本覆盖的区域;
(二)近郊区是指紧靠市区的居民聚居区、蔬菜及主要副食品生产基地、近期城市建设用地等与市区关系密切的区域;
(三)规划控制区是指因城市建设和发展需要实行规划控制的区域,包括与城市发展密切相关的水源地、机场、交通枢纽、高压供电走廊、通讯走廊、风景名胜旅游区、历史文化保护区及其他需要实行规划控制的区域。
城市规划区具体范围,由城市人民政府在编制的城市总体规划中划定。
第四条 自治区、市、县(市)人民政府城市规划行政主管部门主管本行政区域内的城市规划工作。地区行署、市辖区人民政府城市规划行政主管部门分别行使由自治区、市人民政府赋予的本行政区域城市规划实施和管理权限。镇人民政府协助县(市)人民政府城市规划行政主管部门
做好本镇的规划工作。
城市规划行政主管部门负责贯彻执行有关城市规划的法律、法规、规章和政策;组织城市规划的编制、实施和监督管理;参与国土、区域规划及建设项目可行性研究工作;负责城市规划区内建设项目的选址定点;负责城市规划设计和城市勘察、测量的管理工作;查处违法建设。
各级人民政府城市规划行政主管部门的机构设置和人员编制,应当与《城市规划法》规定的行政职责相适应。
第五条 经法定程序批准的城市规划具有法律效力。任何单位和个人均须遵守城市规划,服从城市规划管理,并有权对违反城市规划的行为进行检举和控告。
第二章 城市规划的制定
第六条 编制城市规划,必须符合国家和自治区经济与社会发展的实际,必须遵守《城市规划法》第十三条、第十四条、第十五条、第十六条规定的原则。
编制城市规划应当具备勘察、测量及其他必要的基础资料。
第七条 编制城市规划一般分总体规划和详细规划两个阶段。银川市、石嘴山市在总体规划的基础上编制分区规划和详细规划,其他县(市)、镇在总体规划的基础上编制详细规划,作为城市规划管理和综合开发的依据。
城市总体规划和详细规划的内容应当符合《城市规划法》第十九条、第二十条的规定。
第八条 自治区人民政府组织编制全区的城镇体系规划,用以指导城市规划的编制。
市人民政府负责组织编制本城市的总体规划;市规划行政主管部门负责组织编制本城市的分区规划和详细规划。
县(市)人民政府负责组织编制所在地镇的总体规划;县(市)城市规划行政主管部门负责组织编制县(市)人民政府所在地镇的详细规划。
其他建制镇的城市规划,由所在地市、县(市)城市规划行政主管部门协助镇人民政府编制。
第九条 城市人民政府可以委托具有相应资格的城市规划设计单位承担城市规划的编制。
自治区城市规划行政主管部门负责全区城市规划设计单位的资格审查,并对城市规划设计工作实行统一管理。
第十条 城市规划实行分级审批制度:
(一)银川市的城市总体规划,经自治区人民政府审查同意后,报国务院审批。
(二)其他市和县(市)人民政府所在地镇的总体规划报自治区人民政府审批,其中市管辖的县人民政府所在地镇的总体规划报市人民政府审批,并向自治区人民政府城市规划行政主管部门备案。
(三)其他建制镇的总体规划,报县(市)人民政府审批。
(四)城市分区规划和城市详细规划由市、县(市)人民政府审批;编制分区规划的城市的详细规划,由城市规划行政主管部门审批。
市、县(市)人民政府报请审批城市总体规划前,须经同级人民代表大会或其常务委员会审查同意。
第十一条 城市总体规划应当与国民经济和社会发展计划相协调。城市总体规划的期限一般为二十年,城市近期建设规划一般按五年编制。
城市各项专业规划应当在城市总体规划的指导下,由有关部门负责编制,经城市规划行政主管部门综合协调,纳入城市总体规划。
第十二条 城市人民政府根据城市经济和社会发展需要,可以对城市总体规划进行局部调整,报同级人民代表大会常务委员会和原批准机关备案;但涉及城市性质、规模、发展方向和总体布局重大变更的,须经同级人民代表大会或其常务委员会审查同意后报原批准机关审批。
第三章 城市新区开发和旧区改建
第十三条 城市新区开发和旧区改建必须坚持统一规划,合理布局,因地制宜,综合开发,配套建设的原则,并做到社会效益、经济效益和环境效益的统一。
第十四条 城市各项建设的布局,应当符合以下要求:
(一)建设项目的选址、定点,应当有可靠的水源、能源、交通、环保、防灾等建设条件,并避开有开采价值的地下矿藏、有保护价值的地下文物古迹以及因工程地质、水文地质、地震地质等不宜修建的地段;
(二)居民区应当充分利用自然环境良好的地段,相邻地段的土地利用不得妨碍居住区的安全、卫生和宁静;
(三)安排工业项目应当合理,符合专业化和协作要求。不得在文物古迹保护区和风景名胜区内及其附近安排工业项目,不得在城市主导风向的上风向和水源地上游,安排产生有毒有害废物的工业项目;
(四)新建铁路编组站、铁路货运干线、过境公路、机场和重要军事设施等,应当避开市区;高压供电走廊、微波通道尽量不穿越城市中心区上空;
(五)生产或储存易燃、易爆、剧毒物的工厂、仓库以及严重影响环境的建设项目不得在市区内安排建设;
(六)城市人防工程的规划、建设,应当与城市规划、建设密切配合,并合理开发和综合利用城市地下空间。
第十五条 城市新区开发(包括经济技术开发区)必须预先编制详细规划,并按批准的详细规划实施。
城市新区开发应当依托现有市区,合理利用城市现有设施,按照先地下、后地上的建设顺序,进行配套建设。
第十六条 城市旧区改建必须符合城市规划,重点解决危房区和市政公用设施简陋、交通不畅、环境污染严重的街区及地段。
城市旧区改建应当严格控制建筑密度和容量,集中连片进行建设,禁止零星插建,并应当保持一定的公共绿地面积。
城市人民政府确定的近期改建的街区或地段内原有的建筑物、构筑物不得擅自改建、扩建。
第十七条 城市新区开发和旧区改建,应当保护具有历史意义、革命纪念意义、文化艺术和科学价值的建筑物、构筑物、文物古迹和风景名胜。
历史文化名城的旧区改建,应当严格保护历史文化遗产,体现城市传统风貌、民族风格和地方特色。
第四章 城市规划的实施
第十八条 城市规划经批准后,城市人民政府应当向社会公布。公布的内容包括:城市规划区的范围、城市规划总图、城市近期建设规划、城市规划道路红线以及其他需要城市居民知道的内容。
城市人民政府应当每二年对本行政区域内城市规划实施情况进行一次检查,并将检查情况向同级人民代表大会常务委员会和总体规划批准机关报告。
第十九条 城市规划行政主管部门对城市规划区内的建设用地和建设工程实施统一规划管理。
城市规划区内的土地利用和各项建设必须符合城市规划,服从规划管理。任何单位和个人必须服从城市人民政府为实施城市规划作出的调整用地或拆迁的决定,不得占用道路、广场、绿地、高压供电走廊和压占地下管线进行建设。
第二十条 城市规划管理实行由城市规划行政主管部门核发选址意见书、建设用地规划许可证和建设工程规划许可证的制度。
第二十一条 建设单位或个人报批建设项目可行性研究报告前,应当先向城市规划行政主管部门申请核发选址意见书,作为报批可行性研究报告的必要文件。
第二十二条 城市规划区内的建设项目选址意见书按照建设项目计划审批权限,实行分级规划管理:
(一)经市、县(市)人民政府计划行政主管部门审批的建设项目,由市、县(市)人民政府城市规划行政主管部门核发选址意见书;
(二)经自治区人民政府计划行政主管部门审批的建设项目,由项目所在地市、县(市)人民政府城市规划行政主管部门提出审查意见,报自治区人民政府城市规划行政主管部门核发选址意见书;
(三)中央各部门、公司审批的小型和限额以下的建设项目,由项目所在地市、县(市)人民政府城市规划行政主管部门核发选址意见书;
(四)经国家审批的大中型和限额以上的建设项目,由项目所在地市、县(市)人民政府城市规划行政主管部门提出审查意见,报自治区人民政府城市规划行政主管部门核发选址意见书,并报国务院城市规划行政主管部门备案。
第二十三条 在城市规划区内进行建设需要申请用地的建设单位或个人,必须按以下程序办理建设用地规划许可证:
(一)建设单位或个人持经批准的建设项目可行性研究报告、建设投资计划等有关文件,按建设项目选址意见书确定的选址方案,向城市规划行政主管部门申请定点;
(二)城市规划行政主管部门根据建设工程的技术要求,按照城市规划核定其用地位置和范围,并提供规划设计条件;
(三)建设单位或个人委托具有相应资质等级的设计单位,在城市统一测绘的地形图上编制建设工程设计总图;
(四)城市规划行政主管部门在审查建设工程设计总图符合城市规划要求后,核发建设用地规划许可证。
建设单位或个人取得建设用地规划许可证后,方可向县级以上人民政府土地管理部门申请用地。
第二十四条 在城市规划区内新建、扩建和改建建筑物、构筑物、道路(含铁路、公路、城市道路)、管线和其他工程设施,必须按以下程序办理建设工程规划许可证:
(一)建设单位或个人持建设工程有关批准文件,向城市规划行政主管部门提出申请;
(二)城市规划行政主管部门根据城市规划,对该项建设工程提出规划设计要求,作为规划设计的依据;
(三)城市规划行政主管部门对建设单位或个人提供的设计方案进行审查,并发审查意见通知;
(四)建设单位或个人按审定的设计方案,报送建设工程施工设计图,城市规划行政主管部门审查后,核发建设工程规划许可证。
建设单位或个人在取得建设工程规划许可证和其他批准文件后,方可申请办理开工手续。
第二十五条 建设用地规划许可证和建设工程规划许可证,由建设工程所在地市、县(市)城市规划行政主管部门核发。
建设用地规划许可证和建设工程规划许可证的内容不得擅自变更;确需变更的,须经原发证的城市规划行政主管部门审查同意后,办理变更手续。
建设用地规划许可证和建设工程规划许可证不得买卖或转让。
第二十六条 建设单位或个人在取得建设用地规划许可证后六个月内未申请办理建设用地手续的;在取得建设工程规划许可证后六个月内未开工、又未办理延期手续的,建设用地规划许可证或建设工程规划许可证自行失效。
第二十七条 在城市规划区内进行临时建设的,须持有关批准文件向城市规划行政主管部门提出申请,核发临时建设工程规划许可证;因临时建设或其他用途需要临时用地的,须经城市规划行政主管部门核发临时用地规划许可证后,向所在地县级以上人民政府土地管理部门申请临时用
地。
临时建设工程、临时用地的使用期限不得超过二年,确需延长使用期的,必须按规定办理延期手续。
临时建设工程、临时用地使用期满,使用单位或个人必须无条件拆除临时建设工程,恢复原地貌,按期退还临时用地。临时建设工程在使用期限内,因国家建设需要拆除的,使用单位或个人必须在规定期限内拆除,退还临时用地。
禁止在临时用地上修建永久性或半永久性建筑物、构筑物和其他设施。
第二十八条 城市规划区内重要建设工程竣工验收,应当通知城市规划行政主管部门参加。
城市规划区内建设工程的建设单位或个人应当在竣工验收合格后六个月内向城市规划行政主管部门报送有关的竣工档案资料。
第二十九条 在城市规划区内挖砂石、取土方和设置废渣垃圾堆场、围填水面以及其他改变地形地貌的活动,须事先征得城市规划行政主管部门同意,再按规定报请有关主管部门批准,不得破坏城市环境,影响城市规划的实施。
第三十条 在城市主要街区设置广告牌、画廊、招牌、橱窗或占用人行道设置报刊亭、电话亭、固定摊点等,必须符合城市规划,并经城市规划行政主管部门审查批准。
第三十一条 对在城市规划区内进行的建设(含临时建设)征收城市规划管理费和城市基础设施配套费。
城市规划管理费和城市基础设施配套费的收费标准和使用、管理办法由自治区人民政府规定。
第三十二条 城市规划行政主管部门有权对城市规划区内的建设工程是否符合城市规划要求进行检查,被检查者应当如实提供情况和必要的资料;检查人员进行检查时,应当出示检查证件,并负责为被检查者保守技术秘密和业务秘密。
第五章 法律责任
第三十三条 擅自改变城市规划或违反城市规划要求批准建设项目的,对主要责任人员视情节,由其所在单位或上级主管机关给予行政处分。
第三十四条 在城市规划区内,未取得建设用地规划许可证(含临时建设用地规划许可证)而取得建设用地(含临时用地)批准文件、占用土地的,批准文件无效;占用的土地,由县级以上人民政府责令退回。
第三十五条 买卖或转上建设用地规划许可证或建设工程规划许可证的,由发证的城市规划行政主管部门收回建设用地规划许可证或建设工程规划许可证,没收违法所得,对单位并处二千元至五千元罚款、对个人并处五百元至一千元罚款。
第三十六条 在城市规划区内,有下列行为之一的,由其所在地市、县(市)城市规划行政主管部门视其情节分别给予责令停止建设、限期拆除或没收违法建筑物、构筑物和其他设施;尚可采取改正措施的,由其所在地市、县(市)城市规划行政主管部门责令限期改正,并对建设单位
或个人按建筑工程形象进度造价的百分之三至百分之五处以罚款:
(一)未取得建设工程规划许可证进行建设的;
(二)擅自改变建设工程规划许可证确定的内容进行建设的;
(三)利用买卖、转让手段取得建设工程规划许可证进行建设的;
(四)利用失效的建设工程规划许可证进行建设的;
(五)临时建设工程逾期未拆除的;在临时使用的土地上修建永久性或半永久性建筑物、构筑物和其他设施的。
属于前款第(五)项规定行为的,由县级以上人民政府责令退回占用的土地。
第三十七条 破坏城市环境,影响城市规划的实施,违法占用道路、广场、绿地、高压供电走廊、压占地下管线进行建设和未经城市规划行政主管部门同意在城市规划区内挖砂石、取土方、设置废渣垃圾堆场、围填水面以及其他改变地形地貌的,由城市规划行政主管部门责令停止违法
活动,拆除违法建设工程,恢复原有地形地貌,并处五百元至五千元罚款。
第三十八条 未经批准,擅自在城市主要街区设置广告牌、画廊、招牌、橱窗或占用人行道设置报刊亭、电话亭、固定摊点的,由市、县(市)城市规划行政主管部门责令限期拆除,恢复原状,可并处五百元至一千元罚款。
第三十九条 当事人对行政处罚决定不服的,可以在接到处罚通知之日起十五日内,向作出处罚决定的机关的上一级机关申请复议;对复议决定不服的,可以在接到复议决定之日起十五日内,向人民法院起诉。当事人也可以在接到处罚通知之日起十五日内,直接向人民法院起诉。当事
人逾期不申请复议、也不向人民法院起诉、又不履行处罚决定的,由作出处罚决定的机关申请人民法院强制执行。
第四十条 拒绝、阻碍城市规划行政主管部门工作人员依法执行职务的,由公安机关依照治安管理处罚条例的规定处罚;构成犯罪的,由司法机关依法追究刑事责任。
第四十一条 城市规划行政主管部门工作人员玩忽职守,滥用职权,徇私舞弊的,由其所在单位或上级主管机关给予行政处分;构成犯罪的,由司法机关依法追究刑事责任。
第六章 附 则
第四十二条 未设镇建制的工矿区、农林牧场、风景旅游区等城市型居民点,可参照本办法执行。
第四十三条 本办法自1995年1月1日起施行。

This Ordinance shall have effect notwithstanding any agreement

你省关于审批襄阳市城市总体规划的请示收悉。经国务院批准,现通知如下:
一、国务院原则同意修订后的《襄阳市城市总体规划(2011-2020年)》(以下简称《总体规划》)。
二、襄阳市是国家历史文化名城,湖北省新型工业基地和鄂西北中心城市。《总体规划》实施要以邓小平理论、“三个代表”重要思想、科学发展观为指导,坚持经济、社会、人口、环境和资源相协调的可持续发展战略,统筹做好襄阳市城市规划、建设和管理的各项工作。要按照合理布局、集约发展的原则,推进经济结构调整和发展方式转变,不断增强城市综合实力和可持续发展能力,完善公共服务设施和城市功能,加强城市生态环境治理和保护,逐步把襄阳市建设成为经济繁荣、社会和谐、生态良好、特色鲜明的现代化城市。
三、重视城乡统筹发展。在《总体规划》确定的3673平方公里的城市规划区范围内,实行城乡统一规划管理。要加强城中村和城乡结合部整治和改造,城镇基础设施、公共服务设施建设应统筹考虑为周边农村服务。要根据市域内不同地区的条件,重点发展县城和基础条件好、发展潜力大的建制镇,优化村镇布局,促进农业产业化和农村经济快速发展。
四、合理控制城市规模。到2020年,中心城区城市人口控制在170万人以内,城市建设用地控制在153平方公里以内。根据《总体规划》确定的城市空间布局,引导人口合理分布。根据襄阳市资源、环境的实际条件,坚持集中紧凑的发展模式,切实保护好耕地特别是基本农田。重视节约和集约利用土地,合理开发利用城市地下空间资源。要贯彻落实城乡规划法“先规划、后建设”的要求,严禁在城市总体规划确定的建设用地范围之外设立各类开发区和城市新区。
五、完善城市基础设施体系。要加快公路、铁路、机场和港口等交通基础设施建设,改善城市与周边地区交通运输条件。建立以公共交通为主体,各种交通方式相结合的多层次、多类型的城市综合交通系统。统筹规划建设城市供水水源、给排水、污水和垃圾处理等基础设施,划定基础设施黄线保护范围。重视城市防灾减灾工作,加强重点防灾设施和灾害监测预警系统的建设,建立健全包括消防、人防、防洪、防震和防地质灾害等在内的城市综合防灾体系。
六、建设资源节约型和环境友好型城市。城市发展要走节约资源、保护环境的集约化道路,坚持节流、开源、保护并重的原则,节约和集约利用资源。依靠科技进步,积极开发新能源,大力发展循环经济,切实做好节能减排工作。坚持经济建设、城乡建设与环境建设同步规划,严格按照规划提出的各类环保标准限期达标。按照节能减排目标,明确责任主体,落实工作措施,严格控制高耗能行业的发展,强化工业、交通和建筑节能,加强城市环境综合治理,严格控制污染物排放总量,提高污水处理率和垃圾无害化处理率。要划定城市水系的蓝线保护范围,加强水资源保护,严格控制地下水的开采和利用,提高水资源利用效率和效益,建设节水型城市。要加强对隆中等风景名胜区和森林公园、水源地、自然保护区等特殊生态功能区的保护,制订保护措施并严格实施。
七、创造良好的人居环境。要坚持以人为本,创建宜居环境。统筹安排关系人民群众切身利益的教育、医疗、市政等公共服务设施的规划布局和建设。将廉租住房、经济适用住房、公共租赁住房和中低价位、中小户型普通商品住房的建设目标纳入近期建设规划,确保城市保障性住房用地的分期供给规模和区位布局合理。根据城市的实际需要,稳步推进城市和国有工矿棚户区改造,提高城市居住和生活质量。
八、重视历史文化和风貌特色保护。要统筹协调发展与保护的关系,按照整体保护的原则,切实保护好襄阳古城和樊城历史城区传统风貌。要编制历史文化名城保护专项规划,落实历史文化遗产保护的紫线管理要求,重点保护好樊城陈老巷等历史文化街区、邓国故址等文物保护单位及其周围环境。加强绿化工作,划定城市绿地系统的绿线保护范围,保护好汉江、连山公园等山体和水体,加强汉江景观主轴线的保护和建设。
九、严格实施《总体规划》。城市建设要实现经济社会协调发展,物质文明和精神文明共同进步。城市管理要健全民主法制,坚持依法治市,构建和谐社会。《总体规划》是襄阳市城市发展、建设和管理的基本依据,城市规划区内的一切建设活动都必须符合《总体规划》的要求。要结合国民经济和社会发展规划,明确实施《总体规划》的重点和建设时序。城市规划行政主管部门要依法对城市规划区范围内(包括各类开发区)的一切建设用地与建设活动实行统一、严格的规划管理,不得在《总体规划》确定的建设用地范围以外作出规划许可,切实保障规划的实施,市级城市规划管理权不得下放。要加强公众和社会监督,提高全社会遵守城市规划的意识。驻襄阳市各单位都要遵守有关法规及《总体规划》,支持襄阳市人民政府的工作,共同努力,把襄阳市规划好、建设好、管理好。
襄阳市人民政府要根据本通知精神,认真组织实施《总体规划》,任何单位和个人不得随意改变。你省和住房城乡建设部要对《总体规划》实施工作进行指导、监督和检查。
